EU Data Act: Government pushes for better data control

This groundbreaking legislation is set to enhance control over digital data across the EU, enabling individuals and businesses to utilize their data as they see fit. Specifically, it will establish regulations on access and use of data generated by smart devices, granting more autonomy to consumers and companies. The Act aims to simplify switching and connecting services between various cloud providers, thereby promoting competition and innovation while ensuring a fair data economy.

Minister Adriaansens emphasized the importance of empowering consumers and businesses to access data generated by digitally connected devices such as cars, household appliances, and industrial machinery. Currently, this data is often exclusive to manufacturers and service providers, limiting the data's ownership and shareability by its actual users. The new regulations seek to dismantle these barriers, encouraging competition and fostering an environment ripe for innovation.

Moreover, the EU Data Act will introduce specific rules for data sharing, including reasonable compensation for companies providing access to their data, effective dispute resolution mechanisms, and measures against unfair contractual terms.

Through the internet consultation, stakeholders, including businesses, organizations, and consumers, are invited to share their input on the proposed implementation law, which will designate regulatory authorities and establish sanctions. Following the consultation, the legislation will be reviewed by the Council of State before proceeding to parliamentary discussions in both the House of Representatives and the Senate.

This initiative represents a significant stride towards creating a balanced and just data economy, underscored by new standards and regulations that protect and empower all participants within the digital ecosystem.
